Not 100% sure but that was the impression i was under. Supposedly there are adds playing in the US but there are non in Aus so i cannot confirm.

Sucks to hear dude. I've only had good experiences with the Gopro so far. I've had a few minor problems which the tech support team took care of.

Is everyone using the Curved Adhesive pads? The flat ones tend to fall off because they don't actually stick properly. Also You got to make sure you're cleaning the helmet surface before applying it. My friend uses his on this Motorbike helmet and hasn't had a problem yet.
